Lease agreement
“Emmanouil Drakakis” (hereinafter the “Lessor”) hereby leases to the undersigned Lessee the vehicle, as described herein or any other replacement vehicle pursuant to the terms and conditions of this Agreement as well as the ones included on the front side hereof, which the lessee fully accepts in their entirety, expressly and without reservations.

Driver’s age
The minimum age limit for vehicle category S is 18 years old, for A,B,C,M,G is 23 years, whereas for all other vehicle categories is 25 years.

Driver’s License
Greek, European (for EU countries) or Intemational (for countries not belonging to the EU), issued at least a year ago for vehicle categories: S,A,B,C,M,G and at least before 3 years for all other vehicle categories.

Delivery and Collection
The Lessee collected the vehicle, had it examined and found it to his complete satisfaction, in perfect condition and suitable for the use and purpose for which it is leased. The Lessee is under the obligation to retum to the Lessor the vehicle and all the accompanying documents, tools and parts / accessories in their original condition, and at the location and on the date designated herein. Otherwise, upon return of the vehicle, the Lessee is obliged to pay to the Lessor the normal charge for the use or for any incidental and consequential damage. The Lessor reserves the right to regain possession and use of the vehicle at any time without prior notice and without the written consent of the Lessee, but at the Lessee’s expense, from anywhere or by any means, in any event that, at the discretion of the Lessor, there exists the risk of damage or loss of the vehicle, or use contrary to the terms and conditions contained herein or use contrary to the agreed lease term as well as the risk of not receiving the lease charge or any other due compensation.

Minimum Lease Term
One (1) day (24-hour day). Every additional hour of delay without written extension is charged with 1/5 of the daily charge. Vehicle possession exceeding 3 hours shall be charged an additional day.

Fuel
The vehicle shall be returned with the fuel level same as upon delivery. Otherwise, the Lessee shall be charged with the cost of missing fuel. There is no refund in the event of return of a vehicle with fuel level higher than its initial one.

Extension or Shortening of Lease Term
The Lessee has the right to extend the lease term by notifying the Lessor and receiving his written consent, otherwise the Lessee shall be held civilly and penally liable for illegal use and possession of the vehicle. In the event of extension of the lease term, the Lessee shall be bound by the terms and conditions contained in the initial agreement and the lease extension agreement, either respecting the same, original vehicle or another replacement one. In the event of return of the vehicle prior to the expiry of the agreed lease term, there is no refund.

Fines / Penalties
All fines and administrative penalties incurred during the lease term are born by the Lessee.

lnsurance
The Lessor provides insurance coverage for the Lessee and any other additional driver with an insurance company of the Lessor’s choice. Such an insurance policy must contain provisions easy to review, provisions for material damage of third parties – with the exception of the Lessor’s vehicle –  death or bodily injury caused to third parties inside the vehicle or outside of it (with the exception of the driver of the leased vehicle), on condition that there is no breach of the terms and conditions of this Agreement. The vehicle’s driver and other additional drivers are not covered by the Lessor’s insurance. Luggage or items belonging to the Lessee or third parties are not covered, and the Lessor shall not be held liable for any loss or damage caused to the said property during the lease term or after the return of the vehicle. ln the event of accident the Lessee shall be held liable for any damages incurred to the leased vehicle and the cost of the days required for the vehicle’s repair.

Coverage for Non-insured Amounts
The Lessee may minimize his responsibility with Partial Collision Damage Waiver (CDW), for his legal participation in every damage of the vehicle by paying an amount according to the category of the vehicle, per day of lease. Partial or Full Release of Liability is in effect provided that the Lessee has accepted it by checking the square box “I agree” on the front side of this Agreement and by signing upon it, and through payment of the corresponding daily charge.

Damages
The Lessee is liable to the Lessor or third parties for partial or total theft, loss or damage of the vehicle, documents or parts / accessories or third parties including payment for any incidental and consequential damage incurred to the Lessor. In particular: The Lessee shall be held liable for all the damages he incurs to the vehicle or any third party property in case that he has violated the terms of use of the vehicle or the provisions of the Greek Driving Code (KOK). The Lessee shall be held liable for any damage of the vehicle due to accident on fire. CDW and FDW insurance does not provide any coverage for damages provoked during the transportation of the vehicle by ship, partial or total theft, loss of its parts / accessories or personal property on or inside the vehicle, damages caused to it due to negligence, intent, natural disaster, terrorist act, breach of terms and conditions of this lease Agreement or violation of the provisions of the Greek Driving Code (KOK), damages caused to the vehicle keys, tires, mirrors, lower /upper part of cabin, inside the vehicle, loss of vehicle documents of registration plates.

Charges
The Lessee is obliged to pay to the Lessor at the end of the lease term (unless otherwise agreed) the following amounts: the daily fixed rental charge throughout the lease term of the vehicle, payment corresponding to the fuel level same as upon delivery in the event that the vehicle is returned with a lower level of fuel that when the lease began, estimated amounts for liability release or full liability release, and any other charges provided by the terms of this Agreement. Any expenses incurred by the Lessor, including attomey’s fees and default interest due to the late payment of any of the charges of this lease or recovery by the Lessor of the possession and use of the vehicle. Any fines, penalties, law costs of other costs incurred or likely to be incurred to the Lessor due to breaches committed by the Lessee during the use of the leased vehicle. In this latter case, the Lessee or the additional driver stated on the front side of this Agreement shall continue to be held responsible for any illegal act they may commit, any money required for the restoration and repait of damages as well as compensation for loss of the vehicle or parts / accessories of it, unless the related releases have been accepted and their provisions have been duly applied. The Lessee agrees and accepts that any offered reductions in price are not applicable in the event that the bill issued by the Lessor is not timely paid in full. All charges are subject to final audit by the Lessor, and the Lessee hereby accepts them accordingly.

Terms of Use
The Lessee shall be held responsible for the proper care and maintenance of the vehicle in good condition, control of its mechanical condition, level of oil and water, tires etc., and, in general, he is anticipated to display due diligence. Any type of repair is prohibited without prior consent of the Lessor. The Lessee is not allowed to cross the borders of Greece with the vehicle or use it as a means of transporting people of items in exchange for transportation charges, tow or haul other vehicles or items, follow or participate in rallies, sublease to third parties, for purposes contrary to Greek Law. The leased vehicle must not be used in the event that the Lessee or the additional driver is under the influence of psychoactive substances, which reduce their capacity to drive. The leased vehicle must not be used against the customs, traffic or other laws applicable in Greece, for transportation of heavy appliances, flammable materials, greasy items or ones giving off an unpleasant odor, drugs etc, for illegal transportation of passengers of native or foreign origin, or commitment of illegal acts. In the event of key loss or damage duing the lease term, the Lessee shall be liable for paying 20€ for vehicle categories S,M,G, 60 € for vehicle categories A. B, C and 100 € for vehicle categories D, E, F. In the event that the vehicle is returned with the interior in an unclean state requiring special cleansing (e.g. hair, sand, etc on the seats or on the floor, in the trunk, etc), the Lessee is charged with the amount of 80 €.

Vehicle Transportation
Transporting the vehicle by rail, ship or another mode of transportation is prohibited without the prior written consent of the Lessor.

Liability
The Lessee expressly agrees that the Lessor shall not be held liable for any incidental and consequential damage caused by the Lessee or a third party during the lease term and no clain can be raised against the Lessor for the above reason.

Accidents
In the event of accident, fire, theft etc, the Lessee or the additional driver are obliged to immediately do the following: a) Not acknowledge liability or guilt and claims of third parties in any way, direct or indirect; b) Note the names and the addresses of eye witnesses and also the name and the address of the driver and the data of the vehicle, with which the leased vehicle may have collided; c) Notify the Police to investigate the liability of the third party and provide care to any injurers; d) Contact the Lessor immediately by phone or any other means; e) Collect all relevant information from any third party: f) Photograph the location of the accident and the vehicles participating in the accident, if possible. The Lessee must complete and sign an accident/theft report within twenty four (24) hours at a Lessor’s branch and send any relevant documents or information to the Lessor. In the event of theft or loss of the vehicle, the Lessee must report the incident in writing at the nearest police department immediately or within two (2) hours.

Personal Data
The Lessee consents to the computer storage of his personal data. It is strictly agreed that the Lessor is authorized to use such data, when the Lessee during the lease term makes incorrect statements or breaches the terms of this Agreement and to pass on such data to the country’s authorities in the event of suspicion of committing a criminal or other offence.

Miscellaneous
The vehicle is always property of the Lessor. The Lessee acknowledges that he acquires no rights other than those stated in this Agreement. During the lease term all additional drivers are jointly and severally liable with the Lessee. This Agreement supersedes any other written or verbal agreement between the Lessor and the Lessee. Any alteration of the terms of this Agreement is not valid if not agreed in writing. The Lessee agrees and accepts that all above mentioned terms are valid both in case of the initial agreement with the Lessor and in any case of extension of the time of the lease and/or replacement of the vehicle by another. In the event of diference between the copies and the original of this Agreement the original possessed by the Lessor always supersedes. The contracting parties acknowledge and accept that all terms of this Agreement are substantial and fundamental for the purposes hereof. This Agreement is governed by the Greek legislation and any and all disputes which may arise between the Lessor and the Lessee from this Agreement will be subject to the exclusive jurisdiction of the courts of the registered office or district of the Lessor.
